Posted on: January 30th, 2009 Digitally Acquired Theatrical and High Profile Television Productions in 2008,
We have again sought to chronicle the year in Digital Acquisition, and although the following lists are not as comprehensive as we would have liked, we hope it helps to give a sense of trends in our industry. Since so many Indie Features and television programs are now digitally acquired, we have chosen to list only features bound for theatrical release, as well as some of the higher profile narrative television productions. We are also listing all Live Action 3-D features we are aware of, whether or not they are shot on digital formats. We have tried to list the Title, Director, Cinematographer, Format, (camera/recording system), and Stereographer for 3-D.
Even though we don’t list TV Pilots, we are aware of a tremendous upsurge in those being shot with Digital Cinema cameras. This may be at least partially attributable to the SAG contract impasse, and the fact that shows that are acquired digitally can fall under AFTRA jurisdiction. Should SAG go out on strike, and a show’s actors have been previously organized under an AFTRA contract, (even if they are also members of SAG), they are not required to go out on strike.

MARY KATZKE has been named to head the new Alaska Film Office. Katzke is a former independent producer of feature films and documentaries, based in Anchorage. She can be reached at mary.katzke@alaska.gov.
Draft regulations have been released for public comment. To receive a copy, please send an e-mail to alaska-regs@theincentivesoffice.com.
The Incentives Office was instrumental in the development of the Alaska Incentives bill (SB230), but we have some concerns about the proposed regulations, in particular, the need to deliver a print prior to receiving the credits, and the possibility of tax credit recapture. We will file a formal response addressing these concerns and suggest film-friendly resolutions.

The next Incentives Office event will be held on Friday, February 13, from 9:00 AM to 12:30 PM in Beverly Hills, CA. Our event will feature the following panels:
PRODUCTION INCENTIVES AND THE ECONOMY – Film commissioners from 5 of the major production states — Michigan, Pennsylvania, Massachusetts, Florida and New Mexico — will discuss the impact our economic crisis is having on production incentives in their states – and what they see for the future. Plus,
ADDING VALUE TO THE INCENTIVES — State auditors, third-party CPAs, production accountants and commissioners working in New Mexico, Pennsylvania, Michigan, New Jersey, South Carolina and Massachusetts will discuss how to effectively work with the state auditors, Dept. of Revenue and film commissions to maximize tax credits or rebates for those jurisdictions.
Given the importance of soft money in today’s economy and the need to maximize incentives during production, this is a MUST-ATTEND for anyone planning to produce in an incentives state. CLICK HERE for details.

THE INCENTIVES OFFICE
The Incentives Office provides estimates and vetting of anticipated tax credits or rebates for producers and lenders. We can manage the entire incentives process for producers – from state selection to application preparation and submission, enhancing the incentives, arranging to cash-flow credits or rebates, tracking, filing for monies due, and expediting payment to the producer. Plus we help states develop new incentives or improve the programs they already in place.
INCENTIVES INSURANCE
A few producers have expressed concern about the abilities of some states to honor their rebate and/or tax credit committments. Although we are not aware of any problems at this time, we thought you might like to know that there is insurance available that pays the rebate or credits if the state is unable or unwilling to pay. Send us an e-mail, and we’ll connect you with the broker offering this policy.
CASH-FLOWING THE INCENTIVES
While many mezzanine lenders and banks have stepped away from funding (cash-flowing) the incentives, funds are still available.
